This Disclaimer applies to the website hknewage.com (the "Website") and all products, content, and services provided by Marex Commerce Limited ("we," "us," "our"). By accessing the Website, purchasing our products, or using our services, you ("you," "your") acknowledge and agree to the terms set forth below.

1. Product Intended Use & Metaphysical Statement

Our products including crystals, feng shui ornaments, spiritual accessories, and related items are sold for decorative, collectible, cultural, spiritual, and entertainment purposes only. They are not designed, intended, or marketed as medical devices, therapeutic tools, or treatment for any physical, mental, or emotional health conditions.

We make no claims, express or implied, that our products can diagnose, cure, mitigate, treat, or prevent any disease, illness, or psychological disorder. All descriptions related to energy, spirituality, feng shui effects, and metaphysical properties are derived from traditional cultural beliefs, historical folklore, and subjective spiritual experience—such statements are not scientifically proven, verified, or endorsed by professional medical or scientific authorities.

2. No Health or Medical Guarantees

Our products are not a substitute for professional medical advice, diagnosis, or treatment. For any health-related concerns, you are strongly advised to consult a qualified healthcare provider. We shall not be liable for any loss, injury, or damage arising from your reliance on product-related metaphysical descriptions or use of products as a replacement for professional medical care.

3. Natural Product Attributes

Our crystal and natural stone products are sourced from natural minerals. Minor imperfections including mineral lines, cotton-like inclusions, tiny cracks, surface pits, natural fractures, color variations, and slight size differences are inherent characteristics of natural materials, not product defects. Such natural attributes do not affect product use and are not eligible for return or refund.

4. Website Content Accuracy

We strive to provide accurate, complete, and up-to-date content on the Website, including product images, descriptions, pricing, and information. However, we do not warrant that all content is error-free, complete, or continuously updated. Product images are for reference only; actual products may vary slightly in color, texture, and appearance due to lighting, display settings, and natural material differences.

5. Liability Limitation

To the fullest extent permitted by applicable law:

• We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Our total liability for any direct, indirect, incidental, special, or consequential damages arising from your use of the Website, purchase, or use of products shall not exceed the total amount paid by you for the specific order giving rise to the claim.
• We shall not be liable for damages resulting from force majeure events, improper use, storage, or handling of products by you, or third-party actions.

Nothing in this Disclaimer excludes or limits Our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

6. Compliance with Applicable Laws

This Disclaimer shall be governed by the laws of the Hong Kong Special Administrative Region. For EU consumers, this Disclaimer does not override your statutory consumer rights under the EU Consumer Rights Directive and applicable local laws.
