These Terms and Conditions (“Terms”) govern all transactions between Marex Commerce Limited (“Company,” “We,” “Us,” “Our”) and you (“You,” “Your”) for the purchase of goods (“Goods”) through the website hknewage.com (“Website”).

1. Scope and Definitions

1.1 Geographic Applicability

EU Consumers: Nothing in these Terms restricts your statutory right of withdrawal (14 days) or your legal guarantee of conformity (2 years) under the EU Consumer Rights Directive. The 30-day return period offered under this Policy is an additional commercial guarantee provided by Us.

United States and Other Regions: These Terms constitute the entire agreement regarding returns and refunds between You and Us.

2. Intellectual Property

All content on the Website (including images, text, logos) is owned by or licensed to Marex Commerce Limited. You may not reproduce, distribute, or commercially exploit any content without express written permission.

3. Orders and Contract Formation

3.1 Product listings on the Website constitute an invitation to treat only. By submitting an Order, You make an offer to purchase the Goods.

3.2 A binding Contract is formed upon the earlier of: (a) Our issuance of a written Order Confirmation email; or (b) Our dispatch of the Goods to the carrier.

3.3 We reserve the right to cancel any Order prior to dispatch for reasons including product unavailability, suspected fraud, or obvious pricing errors.

4. Pricing and Payment

4.1 Pricing and Taxes. All product prices are displayed in U.S. dollars and are inclusive of applicable taxes, customs duties, and import fees (including but not limited to value-added tax, sales tax, and tariffs). The price you pay at checkout is the final total price. No additional taxes, duties, or other tax-related surcharges will be charged at checkout or upon delivery. Shipping costs are calculated separately and are not included in the product price unless otherwise stated.

4.2 Payment must be made in full at the time of Order. We accept payments securely through our trusted third‑party payment providers, Stripe and PayPal. All major credit and debit cards are processed via Stripe. You may also choose to complete your purchase using your PayPal account..

5. Return Shipping Cost Deduction Authorization (Core Provision)

5.1 By affirmatively checking the consent box at checkout, You acknowledge and authorize Us to deduct Fifteen United States Dollars (USD $15.00) from Your refund as a reasonable estimate of actual international freight and handling costs incurred, in the following circumstances:

• You return Goods for reasons not attributable to Our error (e.g., change of mind);
• You refuse or fail to accept delivery of the Goods without valid reason.

5.2 This deduction represents a reasonable pre-estimate of Our actual losses and does not constitute a penalty. Actual international air freight costs, interception fees, and handling charges may exceed this amount. We shall absorb any such excess and will not seek additional payment from You.

5.3 This deduction shall not apply if the return is due to Our error (e.g., defective product, wrong item shipped).

6. Limitation of Liability

6.1 To the maximum extent permitted by applicable law, Our total aggregate liability for any claim arising from these Terms or any Order shall not exceed the total amount paid by You for that specific Order.

6.2 We shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill.

6.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited by applicable law.

7. Force Majeure

We shall not be liable for any failure or delay in performance caused by circumstances beyond Our reasonable control, including natural disasters, war, government restrictions, pandemics, or transportation disruptions.

8. Governing Law and Dispute Resolution

8.1 These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.

8.2 Any dispute shall first be attempted to be resolved through good-faith negotiations. If unresolved:

• For U.S. Consumers: Disputes shall be resolved exclusively through binding arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) in accordance with its rules then in effect. The arbitration shall take place in Hong Kong and be conducted in English. You waive any right to participate in a class action lawsuit or class-wide arbitration.
• For EU Consumers: You may bring proceedings in either the courts of Hong Kong or the courts of Your place of residence.

9. Entire Agreement

These Terms, together with Our Privacy Policy and Refund & Return Policy, constitute the entire agreement between You and Us.
